The structural impact of the tutela action in the Colombian Social State under the Rule of Law

This article analyzes the structural impact of the tutela action in the Colombian Social State under the Rule of Law, highlighting its role as a mechanism for the immediate protection of fundamental rights and as a tool for democratizing access to justice. Based on a documentary review of the 1991 Political Constitution, Decree 2591 of 1991, relevant case law of the Constitutional Court and specialized literature, the study examines how tutela has transformed the relationship among citizens, judges and public institutions. The article identifies that this mechanism has brought law closer to everyday life, provided urgent responses to violations of rights such as health, education, liberty and human dignity, and helped correct structural failures of the State. It concludes that tutela is not only a procedural instrument, but also a social and legal institution that materializes contemporary Colombian constitutionalism, strengthens citizen trust and reaffirms human dignity as the foundation of the legal order.
